Our Expertise
A Lasting Power of Attorney (LPA) is a document whereby a person can appoint one or more people to deal with their affairs whilst they are still alive.
An LPA can deal with a person’s financial affairs and also their welfare and care. If a person no longer has the mental capacity to execute an LPA, an Application can be made to the Court of Protection for a Deputy to be appointed to deal with their financial affairs.
Making a Will is the only way to be absolutely certain that your assets will pass to the people of your choice. Without a Will your Estate will be distributed in accordance with the intestacy rules which can mean that family members that you have had no contact with for many years receive a share of your assets following your death.
Wills can also be used to appoint Guardians for younger children and to protect your assets in complex family situations. Our specialist team of Lawyers can also advise in connection with the creation of Trusts and provide tailored inheritance tax advice.
The requirement to pay Nursing Home fees can have a significant impact upon your ability to leave assets to your family. We can give advice on planning for later years and the availability of assistance with the payment of Nursing Home fees when they are required.
More and more people have their assets located abroad, increasing the complexity of the issues relating to Wills and Estate planning. Expert legal advice is essential in these circumstances and you need to be certain that the legislation in a foreign country where you have assets does not conflict with your Will. The particular rules relating to domicile and residence may also need to be considered.
